These Terms of Service ("Terms") are a binding agreement between you and Medlo Health, Inc. ("Medlo Health," "we," or "us"). They govern your access to and use of medlohealth.com and any related services, features, and content (together, the "Services"). By using the Services you agree to these Terms. If you do not agree, do not use the Services.
1. Who may use the Services
You must be at least 18 years old, a resident of a U.S. state in which Medlo Health operates, and legally able to enter a binding agreement. You must provide accurate information when you sign up or complete an intake.
2. Medlo Health is not a medical provider
Medlo Health operates a technology platform. Medlo Health itself does not practice medicine, provide medical advice, issue prescriptions, or dispense medication. Medical services are provided by independent, licensed clinicians through the Medlo Health platform, and prescriptions — if issued — are filled by licensed pharmacies. A clinician may determine that a given treatment is not appropriate for you, and clinician decisions are final.
3. No emergency services
The Services are not for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use the Services to request urgent care.
4. Your account
- You are responsible for the security of your login credentials.
- You are responsible for all activity that occurs under your account.
- Notify us promptly at support@medlohealth.com if you suspect any unauthorized use.
5. Fees and payment
Certain features of the Services require payment. Fees are presented before you are asked to pay. You authorize us or our payment processor to charge your payment method for amounts you have approved. Unless otherwise stated, fees are non-refundable once a clinician has reviewed your intake.
6. Acceptable use
You agree not to:
- Use the Services for any unlawful or fraudulent purpose.
- Impersonate another person or misrepresent your medical history.
- Attempt to access accounts, systems, or data you are not authorized to access.
- Reverse engineer, scrape, or interfere with the Services or underlying infrastructure.
- Upload malicious code or content that harms other users.
7. Intellectual property
Medlo Health and its licensors own all rights in the Services, including the software, brand, content, and trademarks. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services in accordance with these Terms. You retain ownership of any content you submit and grant Medlo Health a license to use that content solely to operate and improve the Services.
8. Disclaimers
To the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. Medlo Health does not warrant that the Services will be uninterrupted, secure, or error-free, or that any information you obtain through the Services will meet your expectations.
9. Limitation of liability
To the fullest extent permitted by law, Medlo Health and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of or related to your use of the Services. Our total liability for any claim arising out of these Terms or the Services will not exceed the greater of $100 or the amounts you paid Medlo Health in the twelve months preceding the claim.
10. Indemnification
You agree to defend, indemnify, and hold harmless Medlo Health, its affiliates, and their respective officers, directors, employees, and agents from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.
11. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts.
12. Changes
We may update these Terms from time to time. Material changes will be posted on this page. Your continued use of the Services after the changes become effective constitutes acceptance of the updated Terms.
